BIKE WAIVER AGREEMENT
Bike equipment can only be hired to a person of 18 years and over. The hirer takes full responsibility for the use
of ALL the equipment, themselves or any third party using the equipment. If the hirer is hiring the equipment for the use by
a person under 18 years of age the hirer/payer of the equipment takes full and complete responsibility for the person
under 18 years of age and they agree that the equipment is fit for purpose, safe and that a full and complete risk
assessment of the equipment and area and/or route which the equipment is to be used is safe to do so. Also that any person/s of
any age using any equipment is wearing the correct safety clothing whether provided by Bayhire or not.
Assumption of Risk: I understand and accept that renting this bicycle or skate equipment and participating in the the
activity exposes me and others to many hazards and entails unavoidable risk of death, personal injury (including but not limited
to severe spinal or head injury) and loss of or damage to property. I also understand I or any other user should be in good
physical health to participate in cycling and I or any other user chooses to participate in cycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and other persons
using the equipment and loss of or damage to property arising out of renting this equipment. I understand the inherent
risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result
to me or any other person.
Waiver & Release: In consideration of Bayhire & Bayhire Scarborough renting me this bicycle , I
specifically release and forever discharge Bayhire & Bayhire Scarborough and its officers, agents, and employees from any
and all liability or claims for injury, illness, death or loss of or damage to property which I or another user may suffer while
renting this equipment. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death
or damaged caused by the negligence of Bayhire & Bayhire Scarborough or its officer agents, or employees. It is my intent
by the Waiver and Release Agreement to release Bayhire & Bayhire Scarborough and hold harmless from all liability for any
such property loss or damage, personal injury or loss of life, whether caused by negligence of Bayhire & Bayhire
Scarborough or whether based upon breach of contract, breach of warranty, or any other legal theory.
In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting
this bike I will have no right to make a claim or file a law-
suit against Bayhire & Bayhire Scarborough, its officers, agents or employees, even if they or any of them negligently cause
my injury, illness, death or damage.
I am fully responsible for any theft or damage while the equipment is under my hire whether the equipment is securely
locked or not.
I understand that this activity may result in severe injury, including but not limited to spinal or head injury. I understand
that this activity may result in hazards posed by other bicycles and traffic or road conditions. I understand how to operate
the rental bicycle or skate equipment and their brakes and how to adjust the seat and quick releases or make other altera-
tions. Bayhire & Bayhire Scarborough staff have answered any questions that I have.
I am to take full responsibility for either intentionally or unintentionally allowing any other person of any age or ability
the use of this hired equipment.
I understand that whilst on Bayhire property, high definition audio and visual security equipment is being used and
recordings are taken as part of my hire agreement and that if needed these recording may be used in any future proceedings or
identity purposes & I understand and accept that any pictures or video taken may also be used for promotional purposes.
Bikes & watersport equipment and skate equipment should be returned in a similar condition to when they are handed
over at the start of your hire. By accepting the bikes and continuing with my hire, I agree that I am happy and have checked the bikes
at the start of my hire are in the best possible condition.
Watersport Equipment Hire (kayaks / paddleboards / surfboards)
In the contract below ‘I’ refers (the hirer) : ‘Bayhire & Bayhire Scarborough’ refers (the company), any errors within this document do not render any or all of the content dismissible.

I understand and accept that renting this Stand up Paddle Board or Kayak or Surfboard or Bodyboard or any other watersport equipment hired from Bayhire and/or Bayhire Scarborough and participating in the water activities exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in Stand up Paddle Boarding or Kayaking or Surfboarding or Bodyboarding or any other watersports. I choose to participate in Stand up Paddle Boarding or Kayaking or Surfboarding or Bodyboarding or any other watersports in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this equipment. I understand the inherent risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result.

In reading and/or signing this document, I fully recognize that if injury, illness, death or damage occurs to me or any third party while I am engaged in using or transporting any hired equipment, I will have no right to make a claim or file a lawsuit against Bayhire & Bayhire Scarborough, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.
I REALISE THE IMPORTANCE OF WEARING A FLOTATION DEVICE/LIFE JACKET, LEASH AND ALL OTHER PROTECTIVE AND LIFESAVING CLOTHING AND EQUIPMENT AND I CONFIRM THAT I HAVE BEEN OFFERED THE USE OF ALL WHICH IS REQUIRED AND I HAVE BEEN STRONGLY ADVISED TO WEAR AND/OR USE THESE AT ALL TIMES.
I confirm that Bayhire staff has answered any questions that I have.
I accept that I am responsible for the replacement value of the equipment if, stolen or lost or the cost of repair if damaged. I understand that I have sole responsibility during my hire period and that insurance cover is my responsibility, and not offered to me by Bayhire & Bayhire Scarborough as part of my hire.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I AGREE TO IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS OR FEELING UNWELL IN ANYWAY.

- is NOT a lifesaving device
- Should only be used by a competent and experienced open water swimmer.
- Should not under any circumstance be left unattended.
- Should not be used by an unaccompanied child
- Should not be used in moderate to strong winds, inclement or poor weather or unsuitable sea conditions.
- Should not be used without the correct clothing and accessories for that particular watersport.
I confirm that:
- I have assessed all weather and sea conditions and confirm I am completely satisfied that the conditions are safe for me to undertake the watersport which I have hired the equipment to do so.
- I take complete and full responsibility for my safety and others whilst using or transporting the hired equipment.
- I take full responsibility for either intentionally or unintentionally allowing any other person of any age or ability the use of this hired equipment.
- I have myself undertaken a full and detailed inspection of the hired equipment and I am completely satisfied that the equipment is safe and suitable to be used as required.
- I agree that I have enough experience to have undertaken a clear and detailed risk assessment of all potential risks involved in hiring and using this watersport equipment and I take full responsibility for satisfying myself that I am safe to continue with the watersport at all times.
- I agree to never take to any open water without informing someone of my intentions, times of departure and return, and route to be taken.
- I am fully responsible for any theft or damage while the equipment is under my hire whether the equipment is locked in a secure area or not.
